Terms of service

The terms on which LakberAI is provided to studios that sign up through the English site.

1. Parties and scope

These terms govern the relationship between Tokár Ádám, a sole trader registered in Hungary (5700 Gyula, Szőlős utca 4/1., Hungary, tax number: 92003747-1-24, registration number: 62232744), as service provider ("I", "the Provider"), and the business that subscribes to LakberAI ("the Subscriber"). The service is meant for interior design and interior architecture businesses. A term agreed in an individual contract takes precedence over these terms.

2. The service

LakberAI is a subscription service that, depending on the package, can include: an AI website assistant, an enquiry and client manager, AI photo-to-render visuals, a quote and contract builder, a client portal, a procurement list, automations, social media messages in one inbox, an AI phone assistant and mood videos. The contract lists which features work when it is signed and which ones I deliver, and by when.

3. AI renders

  • An AI render is an illustration of mood and concept, not a measured design. It may shift proportions or the position of windows and doors and may invent details; no construction drawing can be made from it.
  • The furniture and objects in a render are not specific products that can be ordered. I make no commitment about product availability.
  • The system does not send a render to the Subscriber's client without the Subscriber's approval. The Subscriber is responsible for images sent to clients and for their use.
  • The Subscriber may use the renders freely with its own clients. Whether an AI-generated image is protected by copyright is an open legal question; the final design documents are the Subscriber's professional work.

4. Ordering and setup

There is no online checkout. The contract is formed when the Subscriber accepts my written offer and both parties sign the contract. The contract language is English unless the parties agree otherwise. Setup consists of a call, configuration, data migration and go-live. The Subscriber provides the information needed for the setup (services, prices, texts, style) and is responsible for its accuracy.

5. Fees and invoicing

  • Prices are in EUR. I invoice as a Hungarian sole trader under the Hungarian small business VAT exemption, so no VAT is added to my invoice. Business customers in other EU countries account for any VAT due in their own country under the reverse charge.
  • With monthly billing the fee consists of a one-time setup fee and a monthly fee. With annual billing the Subscriber pays 10 monthly fees for 12 months and no setup fee. Package fees: Solo: monthly fee €99, setup fee €390, annual fee €990; Studio: monthly fee €249, setup fee €790, annual fee €2,490; Office: monthly fee €449, setup fee €1,290, annual fee €4,490; Agency: monthly fee from €899, setup fee from €2,490, annual fee from €8,990.
  • Add-ons: Instagram, Facebook and WhatsApp messages in one inbox €39 a month; Extra user €25 a month; +100 renders €25, one-time; Mood videos, pack of 10 €39, one-time; AI phone assistant, 200 minutes €99 a month; Embeddable render widget €129 a month. A fee agreed in an individual offer may differ.
  • Invoices are electronic and issued in advance: monthly with monthly billing, yearly with annual billing. Payment is due 8 days after the invoice date, by bank transfer in EUR.
  • Late payment: I may charge statutory late payment interest under Hungarian law. If payment is more than 15 days late, after a written reminder, the service may be suspended until the debt is settled; the Subscriber's data is kept during the suspension.
  • Price changes: I may change the fee with at least 30 days written notice, but the list price does not rise during the Subscriber's first 12 months. The Subscriber may terminate free of charge before the change takes effect.
  • With annual billing the Subscriber may terminate without giving reasons within 60 days of the first payment, and I refund the full annual fee within 14 days.

6. Founding partner terms

  • The first 3 Subscribers (Hungarian and international together) pay, as founding partners, 50% of the current list price of their package for as long as the subscription runs without a break. The discount applies to one package and one company and cannot be transferred.
  • There is no prepayment and no free period: the Subscriber pays the discounted monthly fee from the first month, with no setup fee.
  • I put the features listed in the contract live within 8 weeks of signing. If I do not, I refund the fees the Subscriber has paid so far within 14 days, and the Subscriber may terminate with immediate effect.
  • The founding partner agrees to: a 30-minute feedback call each week for the first 3 months, then 1 a month; a named case study with numbers; 2 referrals to other studios; permission to analyse anonymous usage data.
  • If these commitments are more than 60 days overdue, I may end the discount with 30 days notice. A Subscriber who returns after terminating pays the list price.

7. Data protection

For the data of the Subscriber's clients, the Subscriber is the controller and I am the processor. Before the service starts, the parties sign a written data processing agreement that meets GDPR Article 28. Data can be exported at any time; when the contract ends, I make it available for download in a standard format for 30 days, then delete it as the data processing agreement provides.

8. Availability and support

I aim for 99.5% monthly availability. I announce planned maintenance by email at least 2 working days ahead. Faults can be reported to hello@lakberai.hu; I reply within 1 working day on working days (Hungarian time). I am not liable for outages caused by third-party providers, but I help to restore the service.

9. Liability

My liability for damage caused by a breach of contract is limited to the fees the Subscriber paid in the 12 months before the damage. This limit does not apply to damage caused intentionally or by gross negligence, or to harm to life, physical integrity or health (section 6:152 of the Hungarian Civil Code). I am not liable for damage arising from incorrect data provided by the Subscriber, or from using an AI render as a measured design or as a product offer. I do not guarantee any number of projects, revenue or return.

10. Term and termination

A monthly subscription runs for an indefinite period, and either party may terminate it in writing with 30 days notice. An annual subscription runs for 12 months and may be terminated for the end of the period; the paid annual fee is not refunded pro rata, except in the case set out in point 5 or a serious breach by me. Either party may terminate with immediate effect if the other party seriously breaches the contract and does not remedy it within 15 days of a written notice.

11. Consumers

The service is for businesses. If you are nevertheless a consumer, the mandatory consumer protection rules of your country of residence apply in addition to these terms, including the 14-day right of withdrawal for distance contracts. Complaints can be sent to hello@lakberai.hu or to 5700 Gyula, Szőlős utca 4/1., Hungary; I reply in writing within 30 days.

12. Governing law

These terms and the contract are governed by Hungarian law, in particular Act V of 2013 on the Civil Code. The parties first try to settle disputes by negotiation; failing that, the court competent for the Provider's registered address has jurisdiction, unless a mandatory rule provides otherwise.
